Apartment owners intend to legalize house on Levanevskogo Street in Penza

Penza, 26 August 2016. PenzaNews. The owners of apartments in the house on Levanevskogo Street in Penza, which was built illegally, are going to do everything possible to ensure that the building was not demolished. This was reported by Deputy Mayor Irina Shirshina during the 25th regular session of the City Duma on Friday, August 26.

She called the situation with MKD ambiguous.

“When the two sections were built, the case [judicial] was already in progress. The area on which they were built allowed placing the building, but the zoning did not. People made an effort to amend the general plan,” Irina Shirshina explained.

She added that after the demolition of one of the sections, which was built with violations, the owners of apartments plan to file a counter-claim about the legalization of the structure.

“The court is to make the decision, because the finished object is not subject to issuance of a building permit. We have a judicial practice — when the object is ready, we cannot give out permits. Referring to the administration [of Penza], people understand that they will be refused, and then they go to court for the purpose of legalizing unauthorized construction,” the deputy head of the city administration said.
