Penza, 13 June 2012. PenzaNews. Eleventh Arbitration Court of Appeal in the city of Samara satisfied the claim of “RUSMOLCO” to the insurance company “MAKS” in full. Thus, “RUSMOLCO” will receive 13,9 million rubles, 12.8 million of which is the indemnity for the dead 2010 harvest and 1.1 million rubles is compensatory interest for the use or detention of money.

Moreover, the insurance company “MAKS” will reimburse litigation expenses.

The court proceedings to enforce insurance compensation from CJSC “MAKS” in the amount of 12,8 million rubles in favor of “RUSMOLCO” started in 2011. “MAKS” is the second insurance company which recieved a claim by “RUSMOLCO” because it had refused to pay for damage caused by unprecedented drought in the summer of 2010.

According to Elena Firsova, Deputy Director, PR of LLC “RUSMOLCO,” the company had insured three thousand hectares of winter wheat, which was completely or partially destroyed because of soil and atmospheric drought.

Just a few days before filing of a claim to “MAKS,” “RUSMOLCO” has signed a settlement agreement with the OJSC “VSC,” in pre-trial dispute resolution procedure. Trials with “MAKS” lasted more than a year: there were several examinations, many experts made conclusions, the case was adjourned and reopened several times.

“The proceedings diverted a large amount of the company’s resources: our whole team of lawyers had to address this issue during a year. We have repeatedly stated that we would go to the mat, though pre-trial dispute resolution procedure is much easier and cheaper for both sides. We placed a great reliance on the court and now we are satisfied with the result,” said General Director of “RUSMOLCO” Rashid Khairov.
