Federal Arbitration Court: “Rostelekom” is not dominant in the market of local telephone service

Penza, 10 October 2012. PenzaNews. Federal Arbitration Court of the Volga District dismissed the appeal from the Federal Antimonopoly Service in the Penza region on recognition of “Rostelekom” occupying a dominant position in the market of local telephone service.

According to the press service of the Penza branch of “Rostelekom,” Federal Arbitration Court accepted the acts on the case as legal, and the appeal from the Federal Antimonopoly Service in the Penza region — unfounded and non-satisfactory.

“Earlier, disagreeing with the order of the Federal Antimonopoly Service to include “Rostelekom”, represented by Penza branch, in the list of economic entities with market share of certain goods in the amount of more than 35% or taking a dominant position in the market for a certain product, the company appealed to the Arbitration Court of the Penza region to declare a non-normative act illegal,” the press service pointed out.

“According to the company's lawyers, the order was submitted with significant violations of applicable law, because the basis for its issuance was the reorganization of “VolgaTelekom” merging with “Rostelekom”, but the Federal Antimonopoly Service did not carry out analysis of the relevant market, which is a violation of existing law,” explained in the company.

The requests of “Rostelekom” were met in full at the stage of the first review in the Arbitration Court of the Penza region.
