Court finds 14 buildings of “ZIF” factory in Penza to be state property

Penza, 7 December 2016. PenzaNews. The arbitration court of the Penza region declared the Russian Federation property right for 14 real estate units of JSC “ZIF” and JFC “ZIF Plus”.

Thus, the claims of the regional department of the Federal Agency for State Property Management were answered.
As the senior assistant of the head of the regional prosecutor for media relations Svetlana Artamonova told PenzaNews, the disputable objects were the manufacturing building, specialized storehouses and the workroom with the total area of more than 19,000 square metres, located in Gagarina and Lenina streets in Penza.
“The regional department of the Federal Agency for State Property Management stated that these objects were not liable to privatization by JSC ‘ZIF’ in 1994, because they were intended for manufacturing and storage of special goods. According to law, the disputable objects are the federal property, that is why it was illegal of JSC ‘ZIF Plus’ to register it as its own belonging in the agreements of sale and purchase signed in 2009 and 2011,” the interlocutor explained.
She added that JSC “ZIF Plus” did not agree with the statement of claim.
“The organization asked to dismiss the action alleging that the privatization of the disputable property had no law violations, and that the limitation period is already over. JSC “ZIF” left the dispute resolution at the court’s discretion,” Svetlana Artamonova specified.
The decision of the arbitration court of the Penza region can be appealed at the 11th arbitration court of appeal during a month from the date of its approval.
