JSC Biosintez suspected of unethical competition in Penza

Penza, 1 April 2013. PenzaNews. The case against JSC Biosintez suspected of unethical competition connected with acquisition and use of exclusive rights for the trademark “Anuzol” was filed by the Federal Antimonopoly Service of Russia in the Penza region on Monday, April 1.

“The case was initiated at the request of JSC Nizhpharm from Nizhny Novgorod indicating that the medical product called “Anuzol” has been produced by them since 1971, and JSC Biosintez began their production only in 1998. Despite this fact, in 2004, Penza company registered “Anuzol” trademark and advised JSC Nizhpharm to discontinue the use of the trademark or make a license agreement,” the Head of the Federal Antimonopoly Service of Russia in the Penza region Maksim Beloborodov.

He explained that, according to the claimant, the actions of JSC Biosintez are directed not at individualization of their products, but monopolization of “Anuzol” trademark in order to eliminate all other producers of similar goods.

“The request of Penza pharmaceutical plant to stop production of “Anuzol” drug or make a license agreement on a remuneration basis may cause financial losses to JSC Nizhpharm. The trial is scheduled for April 23,” the agency interlocutor pointed out.
