Two houses under construction to be demolished by court decision in Penza

Penza, 22 May 2013. PenzaNews. The decision of the court on the demolition of two blocks of three-storey houses in Gogolya St in Penza with the total area of 1,841 square meters erected illegally on the plots of land designated for private houses, entered into force. This was announced by the press secretary of Penza regional court Natalia Bychenkova on Wednesday, May 22.

She noted that the city administration applied to the court, stating the absence of building permits of the defendants and required to oblige them to demolish illegally constructed buildings.
“When making a decision, Leninsky District Court of Penza took into consideration the fact that over 40 people were involved in the case as a third party who purchased the living space according to unregistered preliminary contracts of sale. As a result, the court made a decision to satisfy the claims of the City Hall and ordered the defendants to demolish illegally constructed buildings,” she commented.
The agency interlocutor also noted that the defendants and the third party did not agree with this decision and appealed to the regional court.
“Judicial board on civil cases refused in satisfaction of the claims, and left the decision of Leninsky District Court of Penza unchanged,” Natalia Bychenkova concluded.
