Penza, 12 November 2013. PenzaNews. Violations of legislation on clemency were detected in the Penza penal colony No. 7 during the prosecutor’s investigation.

According to the legislation in power, clemency is given by the President of the Russian Federation to a given person. The procedure for the consideration of such requests is specified by the Decree of 28 December 2001. However, there were established facts that the administration of the penal colony No. 7 filed clemencies applications to bodies, competence of which does not lie in consideration of such applications,” the senior assistant attorney of the Penza region Yuliya Makarova told news agency “PenzaNews.”

She added that these actions might result in negative consequences in the form of violations of the rights of convicted persons.

“Subsequent to the results of the inspection of the observance of the law in correctional facilities the Penza prosecutor gave warning to the acting head of the colony about inadmissibility of such violations,” the agency interlocutor said.
