Penza regional court changed the decision of Zarechny city court, according to which the municipal enterprise “Avtotrans” was to recover compensation for moral damage in favor of the passenger who injured her leg while moving in the cabin of bus No. 103 in July 2013.

“It was established that the woman stumbled in the cabin of the bus due to a significant level difference of the floor. She was diagnosed with a sprain of ligaments of her right ankle. According to the victim, in the course of treatment she was forced to use taxi service repeatedly to get to the hospital and back. In this regard, she requested to recover all the trip expenses, compensate moral damage, return the state duty and the cost of preparation of the statement of claim,” the press secretary of the regional court Natalia Bychenkova commented.

She added that the fault of the victim in getting the damage was not established as well as the fault of the driver, who did not exceed the speed limit or step sharply on a brake.

“Given that the victim did not provide reliable evidence of taxi expenses in the stated amount, the court found this part of the claim ungrounded and not subject to satisfaction. As a result Zarechny city court made a decision to recover from “Avtotrans” only moral damage in the amount of 1,500 rubles, expenses for preparation of the statement of claim in the amount of 200 rubles, and payment of state duty — 200 rubles,” the agency interlocutor clarified.

Natalia Bychenkova pointed out that the woman did not agree with this decision and appealed.

“The judicial board on civil cases of the Penza regional court considered arguments of the complaint and satisfied it. As a result, the amount of moral damage was increased to five thousand rubles. Also the insurance company recovered taxi expenses in the amount of 250 rubles classified as expenses caused by damage to health and confirmed by admissible evidence. The decision came into force,” the press secretary of Penza regional court summarized.
