Penza, 11 November 2014. PenzaNews. Penza regional court upheld the decision of Penza district court dated October 6, 2014, which confirmed the decision of the regional department of Rospotrebnadzor against LLC “Termodom.”

“According to this decision, the construction company was found guilty of an administrative offense — illegal sand extraction in Sura river branch. It was found that the extraction was carried out without a water body exploration permit. The company was sentenced to a fine of 20 thousand rubles. Disagreeing with this decision, the representative of LLC ‘Termodom’ submitted an appeal. He explained that sand extraction was carried out on a site that does not belong to the category of water fund lands and the company is not the user of the water body. However, these arguments were found invalid,” Natalia Bychenkova, Penza regional court spokesman, told PenzaNews agency.

She explained that LLC “Termodom” is obtaining its sand using hydraulic fill technique with dredgers owned by the organization.

“In addition, the regional department of Rospotrebnadzor found that sand extraction is carried out on water body — the dike is 20 meters from the water edge in Sura river branch, that is the dike is in the 200-meter water protection zone,” the agency interlocutor added.

Natalia Bychenkova clarified that for this reason, the appeal against the decision of Penza district court was dismissed.
