Penza, 30 May 2012. PenzaNews. Deputies of Legislative assembly of the Penza region passed the law “About Governor Elections in Penza Region” in the first and in the second reading in final edition during the session on Wednesday, May 30. The speaker of regional parliament Alexander Gulyakov explained that, according to the law, the governor of the Penza region is elected for five-year term by universal, equal and direct suffrage by secret ballot.

“Governor candidates are nominated by regional offices of political parties. 8% of deputies of municipalities and (or) heads of municipalities of the Penza region elected in municipal elections should support promotion of the candidate,” noted Alexander Gulyakov.

According to the spokesman, this percentage is defined from total number of deputies of representative bodies of the municipalities, provided by charters of these municipalities at date of decision-making purpose of elections of the governor and number of heads of municipalities elected and operating at date of adoption of the specified decision.

“The registered governor candidate should gather more than 50% of votes. If there were more than two registered candidates in the ballot and none of them was elected, there will be revote of two registered candidates having received the greatest number of votes,” declared the speaker of the regional parliament.

Besides, during the session they adopted the law “About Order of Recall of Governor of Penza region” which provides recall of the governor in cases of violation of legislation of the Russian Federation or Penza region law or numerous dereliction of duty without valid excuse. It should be noted that the facts of law violation and dereliction of duty should be set by court.

Procedure of governor recall is held on the initiative of the citizens according to the rules of the referendum of the Penza region, taking into account the following peculiarities: proposal of recall can be put forward not earlier than one year after governor’s entering upon the office; vote on a recall is appointed by Legislative assembly of the Penza region with all grounds of recall and the required number of signatures, which is 25% of all number of people participating in votes on recall, registered in the territory of the Penza region; vote on a recall is held not later than 60 days since day when Legislative Assembly of the Penza region made a decision about recall vote.
