Penza regional court left unchanged Leninsky district court of Penza decree dated November 21, 2011, obliging Penza administration to erect pollution control facilities near Bakunina Street bridge, monument “Rostock” in Slava Street and at the dam near heating and power plant No1.

“The facts of violations of the nature protection legislation repeatedly came to light Federal Nature Management Supervision Service management across the Penza region on what the city administration and the region government were informed,” reported Natalia Bychenkova, the press secretary of regional court.

She specified also that the resolution of the head of city administration approved the target program “Reconstruction and development of storm sewerage system in Penza for 2009-2017” according to which it was supposed to allocate money from the city budget and to construct 115 km and to reconstruct 50 km of networks of the rain sewerage by 2017 and also erect 20 treatment facilities.

“In the absence of means in 2009 execution of this program was suspended, and the resolution of the head of administration of Penza is cancelled,” the spokeswoman added.

As noted the press secretary, dumping to the Sura of crude sewage led to identification of excess of maximum permissible values of harmful substances in the river.

“On August 3, 2011 the prosecutor of the Lenin district of Penza to the head of city administration brought representation, however effective measures on elimination of the allowed violations it was accepted not,” she emphasized.

According to Natalia Bychenkova, representatives of the respondent asked to refuse satisfaction of the claim administrations of Penza, and also representatives of the third parties department of housing and communal services, management of housing and communal services, financial management and municipal duma.

“However Leninsky district court, having considered arguments of all parties, came to a conclusion about satisfaction of the claim and obliged administration of Penza to take measures to construction of treatment facilities for the purpose of an exception of dumping of crude sewage to Sura,” she specified, having added that the respondent disagreed with this decision and made in the Penza regional court the appeal which was left without satisfaction.

“The court recognized an existing condition of water removal of a superficial drain around the city to Penza unsatisfactory and dangerous in the ecological relation. The decision entered validity,” the spokeswoman summarized.
