Penza city council decision “On approval of rules for land use and development of Penza” was declared invalid in arbitration court because of unidentified boundaries of zones of sanitary (mountain sanitary) protection of natural medicinal resources, therapeutic areas and resorts of Akhuny village. “Akhuny is a resort of regional importance according to the decision of the Penza region government as of February 8, 2000. Health resorts named after V. Volodarsky, “Serebryany Bor” (Silver Forest), as well as holiday home named after S. Kirov are located there. However, when making land use and development provision the above Penza regulations were not considered,” reported the press service of the Prosecutor’s Office of the Penza region.

The ministry clarified that the territory actually referred to the county sanitary (mountain sanitary) protection of therapeutic areas and resorts by allowing the residential area and therefore, the allocation of land to economic entities and individuals by the local government, in this case is illegal.

“Improper land use of therapeutic areas and resorts in the end leads to pollution of the environment and negative impact on treatment and rest,” said the Prosecutor’s office of the Penza region.

The press service added that in order to prevent further mass development in protected areas of the Penza region the deputy prosecutor applied to the court.

“The arbitration court approved the deputy prosecutor’s application, and the decision “On approval of rules for land use and development of Penza” was declared invalid because of unidentified boundaries of zones of sanitary (mountain sanitary) protection of natural medicinal resources, therapeutic areas and resorts of Akhuny village. The decision came into force. It was appealed against, but the cassation court left it unchanged,” concluded the press service of the Prosecutor’s office in the region.

Natural medical resources, health and recreational areas, as well as resorts and their land are recognized protected natural areas in accordance with the Federal Law “On natural health resources, health and recreation areas and resorts.” Their protection is carried out through the establishment of zones of sanitary (mountain sanitary) protection.
