Illegally constructed 4-storey building to be demolished in Penza

Penza, 18 April 2013. PenzaNews. Penza regional court made a decision to demolish illegally constructed 4-storey building located on three plots of land intended for individual housing.

“It is established that on November 24, 2008 they approved the project site boundaries, the land of which was intended for construction of residential houses. According to the sales contracts, the owner of the three plots of land is the defendant who sold shares on two of these plots to 26 co-owners,” the press secretary of Penza regional court Natalya Bychenkova commented to news agency “PenzaNews.”

According to her, the municipality of Penza stated in the lawsuit that the construction was being carried out on the three plots of land without duly issued permit, which is why the defendant was brought to administrative responsibility.

Natalya Bychenkova added that a representative of the defendant insisted on the absence of evidence to the fact of the construction of an apartment building, so, in his opinion there was no violation of the designated use of land.

“Pervomaysky district court of Penza concluded not to satisfy the claim of Penza administration. The decision was appealed. As a result, the panel of judges in civil cases of Penza Regional Court reviewed the previous decision. As one of the plaintiff's evidence of claim validity, the court accepted construction contracts between the co-owners of the land and the construction company, according to which latter had an obligation to construct an apartment building. The co-owners retained certain apartments,” Natalia Bychenkova explained.

The press secretary of Penza regional court also noted that the decision has come into force.
