Penza, 5 September 2013. PenzaNews. The Department of Capital Construction of Penza appealed to the Arbitration Court of the Penza region with a claim to recover for delay in performance of the contract for the overhaul of Moskovskaya Street from JSC SKM Engineering.

According to the text of the document, a copy of which is available to news agency “PenzaNews,” on August 7, 2012 the parties entered into contract costing 339,272,224 rubles for a range of work “Reconstruction of road network of Penza. Overhaul of Moskovskaya Street from Bakunina Street to Kuraeva Street. Construction of underground pedestrian crossing Moskovskaya Street — Gorkogo Street.”

“According to paragraph 3.3., the work had to be completed by August 31, 2013. However, it was not done within the contract terms which is a violation of essential conditions,” the statement claims.

According to the calculations of the plaintiff, the penalty for the delay of two days — September 1-2 — amounted to 678,544 rubles.

“Please pay attention to the social importance of the object, which is a priority of a long-term target program “Preparation for the celebration of the 350th anniversary of the founding of Penza.” The defendant has not met the obligations which affected the timing of other types of work in Moskovskaya Street, which in turn led to a breach of interests of an indefinite number of persons, and subsequently can cause wide public resonance,” the document, signed by the head of the Department of Capital Construction of Penza Magomed Agamagomedov, stated.
