Penza, 1 May 2014. PenzaNews. The Arbitration Court of the Penza Region has satisfied the claim of “Mercuriy” private company to claim 40,247,424 rubles from “Penza Passenger Transportation” municipal enterprise.

According to the wording of the court judgment, said sum is a compensation of losses that the company suffered due to social security beneficials transportation in 2010. That includes more than 15 mln rubles for federal beneficials and more than 25 mln rubles for regional ones.

It was established that in March 2007, Penza Administration of Transport and Communication has conducted a competitive selection procedure for public transportation on regular city rouets, including routes 54 and 89. During the procedure, “Penza Passenger Transportation” municipal unitary enterprise was deemed an only transport operator for the two routes mentioned, and the Administration entered into a contract with the enterprise.

Subsequently, the municipal enterprise entered into an intermediary contract with “Mercuriy,” LLC, which required conducting transportation service of various passenger caterogies – both Social Security beneficiaries and other citizens – on bus routes 54 and 89.

The court found the stated claims subject to satisfaction, and the statements of defense and third parties unsound and inconsistent with the active legislation and common practice when dealing with such claims.

The judgment of the Arbitration Court of the Penza Region can be appealed within a period of one month.
