Penza, 12 February 2015. PenzaNews. According to the court decision, Penza company “Avtolotsman” has been ordered to pay nearly 400 thousand rubles to the owner of an Opel Astra.

“In her address to the court, the woman said she acquired an Opel Astra from LLC ‘Avtolotsman’ at the price of 683,400 rubles in 2010, with a warranty period of two years with any mileage set by the manufacturer. Since the purchase, the foreign car has been serviced at the authorized center of the defendant. All maintenance was performed on time and in accordance with the manufacturer’s requirements, as evidenced by the mark of Warranty Booklet. On May 24, 2012, during a routine checkup, the woman gave the car to the defendant, and reported on the problems, including a stuttering engine and a blinking sign of low oil pressure,” Natalia Bychenkova, press secretary of Penza regional court, informed PenzaNews agency.

She said that during the maintenance inspection, among other work, the specialists changed the oil.

“In the course of further vehicle operation, they revealed deficiencies made during the maintenance work, which, according to experts, were the result of using low-quality oil. Afterwards, the plaintiff asked the defendant to eliminate the defects free of charge, but this was not done. The defendant was sent a written claim for remedial maintenance reimbursement, but no proper response has been received. As a result, the owner of the vehicle was unable to use the car for over two years. In this regard, she had to lease a Ford Fusion for a total of 180 thousand rubles for the period from July 1, 2012, to June 13, 2014,” the agency interlocutor explained.

According to her, having examining all the case materials, the court made a decision to partial satisfy the requirements of the plaintiff.

“As a result, LLC ‘Avtolotsman’ will pay the woman the cost of remedial work (37,567 rubles), the overdue payment (37,567 rubles), the losses (180 thousand rubles), the compensation for moral damages (5 thousand rubles), the fine (130,068 rubles) and the state fee (5,951 rubles). Disagreeing with this decision, the representative of the defendant filed an appeal that was later dismissed by the judicial board on civil cases of Penza regional court. The decision has come into force,” Natalia Bychenkova noted.
