Court supports Federal Antimonopoly Service in “TNS Energo Penza” case

Penza, 30 June 2015. PenzaNews. The Arbitration Court of the Penza region has denied the claim of “TNS Energo Penza” to deem the February 5, 2015 decision of the regional Federal Antimonopoly Service department to punish it with a fine of 150,000 rubles, says the message published at the website of the Penza region FAS department on Tuesday, June 30.
In February, “TNS Energo Penza” was found to be in violation of Part 1, Art, 10 of the federal competition protection law, it reminds.
The antimonopoly department found that the company was demanding its users to pay for the reprogramming of multi-tariff power meters, a case not included in the current legislation, that may cause or have caused damages of interests to other parties.
As a result, TNS Energo Penza was fined 150,000 rubles under Part. 1, Art. 14.31 of the Administrative Code, titled “Abuse of Dominating Position in Goods Market.”
The company disagreed with the decision and decided to appeal it through the court.
