Penza court orders driver to pay alimony to road accident victim’s son

Penza, 3 July 2015. PenzaNews. The driver who hit and killed a woman on Gagarina street of Penza on March 17, 2013, when she had been crossing the street in an illegal zone, is now obligated to pay a monthly alimony of almost 7,000 rubles to her son until he is 18, or until the end of his full-time higher education course that does not exceed his age or until his 23rd birthday, whichever comes first.

“The driver will be facing a criminal case due to the accident, as there was no legal element of crime,” Natalya Bychenkova, press secretary of the Penza region court, informed PenzaNews agency.

She also added that the litigant did nothing to compensate the damages on his own.

“He wrote letters to the court, saying he did not cause the incident. Moreover, ‘Rosgosstrakh’ has paid a one-time compensation of 135,000 rubles for the loss of the wage earner in the family. The driver also said he is in a difficult financial position and his family has to pay out loans,” the speaker said.

Natalya Bychenkova added that the accident was caused by the late woman who had been crossing the road in an illegal zone; however, the driver bears responsibility for the event as the harm was caused by a car driven by him.

“The court has partially satisfied the demands of the accusation side and fined the litigant a total of 300,000 rubles,” the press secretary continued.

She added that the litigant disagreed with the verdict and appealed the case, but without any success.

“The decision has entered into force,” the speaker concluded.
