Case of TNS Energo Penza dissolving agreement with management company may get to court

Penza, 14 August 2015. PenzaNews. Deputy head of Penza administration, Yuri Ilyin informed that the issue of TNS Energo Penza — regional electricity supplier — unilateral agreement dissolution with management companies, which previously concerned regional office of FAS, may be sent to court.

“[...] The parties could not work out the problem,” vice-mayor explained at a meeting of the permanent commission of the City Duma on utilities, landscaping and ecology on Friday, August 14.

According to him, the unilateral contract dissolution in case of non-payment of more than three billing periods, could turn into double receipts for electricity for more than 90 thousand Penza residents of nearly 400 houses.

“The volume of consumption, formed from July 1 to 11, should be reflected in the payment document from the management company, the rest — from July 11 to 31 — a separate document from TNS Energo Penza,” Yuri Ilyin noted.

He added that currently the situation is resolved.

“By the end of July the houses, with management companies of which the contract had been dissolved, will receive one electricity payment statement by TNS Energo Penza,,” vice mayor clarified.

As PenzaNews agency reported earlier, the FAS got interested in the unilateral contract dissolution after the company TNS Energo Penza sent corresponting letters to 53 urban management companies. The antimonopoly authority explained that the agreements are public, and therefore unilateral termination is inapplicable for them under the current law.

Criminal proceedings were instituted on violation of law “On Protection of Competition.”

Initially, the case hearing was scheduled for July 16, but then moved to the second half of August.
