Penza, 23 August 2015. PenzaNews. The arbitration court of the Volga District dismissed the cassation appeal of the FAS in the Penza region on charges of alleged carriers' anti-competition agreement in Penza.

As the statement of the arbitration court of cassation notes, the decision of the arbitration court of the Penza region of 1 April 2015 and the decision of the Eleventh Appellate Court of June 16, 2015 were upheld.

As PenzaNews agency reported earlier, by the decision of the FAS in the Penza region of October 30, 2014 “Korporatsiya Dilizhans,” LLC “Merkuriy” and “Penza Passenger Transportation” were found guilty of violating the Competition Protection Law. According to the antimonopoly authority, the companies entered into an anti-competition agreement which resulted or may have resulted in the market division to manage the city commute routes.

The companies received orders on elimination of antimonopoly law violations.

The decision of the arbitration court of the Penza region of April 1, 2015 deemed the FAS decision and orders null and void.

The Penza region FAS appealed. However, on June 16, 2015 the Eleventh Appellate Court dismissed the appeal.
After that, FAS applied to the court of cassation.
