Penza city administration explains case over possible Yagodnaya street construction

Penza, 19 September 2015. PenzaNews. The Penza city administration seeks to undertake all necessary measures to ensure any construction site on Yagodnaya street, 9A follows all urban planning and construction rules and regulations, says the press release distributed by the city hall following the media reports on a possible construction site emerging in this land plot.

“The potential construction on the aforementioned plot of land will take into account the regulations for the land plots located within the mineral water sanitary protection zone of Penza city,” reads the report of the press service.

According to it, the owner of the land plot, following Art. 236 of the Civil Codex of Russia, may erect, rebuild or level any buildings or constructions on it or give permission to do so to a third party, if and when all urban planning and construction rules and regulations are followed and the requirements on the eventual purpose of the land plot is taken into account.

“The plot of land of 6,629 sq. meters on Yagodnaya street, 9A of Penza city is owned by a legal entity and classified as land within a residential area. On June 10, 2015, the state cadastre of immovable property was updated with the information on the second mineral water protection zone in Penza, that received the ID 58.29.2.382. The aforementioned plot of land was included in this zone. Following Art. 16 of the Federal Law No. 26-FZ, dated 23 February 2015, ‘On Natural Medicinal Resources, Medicinal and Recreational Areas and Resorts,’ any construction within the zone not directly related to creation and development of health resort and recreation field, as well as any works that may lead to contamination of the environment, or cause contamination or depletion of the natural medicinal resources, is prohibited in that zone. The Penza city administration decree No. 641, dated May 8 2015, provided for changes in the Rules of Land Use and Construction in Penza City. The Penza city administration decree No. 1186, dated 28 July 2015, set grounds for additional changes in display of the sanitary zone around the mineral water springs in Penza city on the urban planning map, following the suggestion of the health resort management organization ‘Penzaprofkurort’,” says the press release.

It also adds that the project of the changes was prepared, published both on the city hall website and in the August 10, 2015, issue No. 46 (226) of the newspaper “Municipal News. Penza,” and is due to review during the public hearings on October 12.

“Following the Penza city administration decree No. 944 dated June 24, 2015, the Penza city Urban Planning and Architecture Department is currently working on new projected changes to the Penza city general plan. In particular, this will provide for proper display of the mineral water protection zone on the Penza city general plan,” says the message of the city hall.
