Car owner wins 173,000 rubles in lawsuit after getting stuck in pothole by Penza city hall

Penza, 18 March 2016. PenzaNews. The Penza region court has upheld the verdict of the Leninsky Penza city area court to fine a road repairs organization 173,000 rubles in favor of a driver of a Mercedes-Benz E 240 that got stuck in a pothole by the city hall, as compensation for damages.

“In his lawsuit, the man in question described that in the evening of 23 February 2015, his car got stuck in the pothole on the road by Marshala Zhukova street, 4, which was not marked by any road signs signaling road damage or repairs at the location,” Natalya Bychenkova, press secretary of the Penza region court, informed PenzaNews.
The incident left the imported car, among other things, with damages sustained by its windshield, the AirBag system in the driver’s and front passenger’s seat, the bumper, the condenser, the radiator, the front-axle beam and the dashboard, she clarified.
“After investigating the matter, the court concluded that the pothole appeared due to action of the organization that conducted repairs on the road, as it failed to restore the road covering after the repairs,” she pointed out.
The representative of the road repairs organization appealed the verdict, but the appeal has been dismissed, Natalya Bychenkova explained.
“The decision has entered into force,” she clarified.
