Kuznetsk resident collects up to 600 thousand rubles for soaked apartment during firefighting

Penza, 25 August 2016. PenzaNews. The insurance company will pay up to 600 thousand rubles to the resident of Kuznetsk, the Penza region, whose apartment was flooded during the firefighting.

“On October 28, 2014 the man and the company signed a contract of insurance under which the property interests of the insured relating to the possession, use and disposal of real estate pledged to the beneficiary. In accordance with clause 1.5 of the contract, the beneficiary is a commercial bank, and the object of insurance, among other things, is the flat belonging to the man,” the official representative of the Kuznetsk district court told PenzaNews.
He said that in September 2015, there was a fire in the apartment building, and the plaintiff's flat was flooded during the firefighting.
“This apartment is the object of the insurance contract. The plaintiff applied to the defendant with the message of the insured event, attached all the documents collected by him, confirming the incident. The insurer sent a reply in which, referring to paragraph 2.2 of the insurance contract, refused to pay the insurance indemnity. The refusal is motivated by the fact that the decoration of premises is not included in insurance coverage, and during firefighting interior fittings were damaged, namely — stains on the ceiling, walls, yellow smudges, wet traces on the floor covering, which are not object of insurance protection under the concluded contract,” the agency interlocutor added.
According to him, two conclusions of forensic examinations, appointed during the proceedings, confirmed that the structural elements of the disputed apartment were subjected to the flooding as a result of firefighting, eventually causing damage.
“The court granted the claim in part and enforced from the insurance company the insurance compensation in the amount of 377,141.68 rubles, compensation for moral damages in the amount of 10 thousand rubles, the penalty for failure to comply on a voluntary basis to meet customer requirements in the amount of 193,570.84 rubles, and the state fee — 7,271.42 rubles,” the court spokesman noted.
