“On December 26, 2015 near Penza-III train station the plaintiff’s son, born 1997, climbed to the second span of the railway bridge seeking for sharp sensations. There he received electric shock of working voltage 27.5 kV and fell from 8-meter height. The young man died of combination of electric shock and head injuries,” the senior assistant of the head of the regional prosecutor for media relations Svetlana Artamonova told PenzaNews.

According to her, despite the fact that the cause of the accident was personal reckless acts of the deceased, who was in a state of intoxication, as well as violation of staying in hazardous areas, non-pecuniary damage shall be compensated by “Russian Railways” JSC as the owner of the source of increased danger.

“Taking into account the requirements of the law and facts of the case, the district court upheld the claims of the Penza transport prosecutor in the interests of the father of the deceased for the recovery of non-pecuniary damage, and assigned the duty of payment to the Insurance company “Soglasie” — a civil liability insurer of “Russian Railways” JSC,” the agency interlocutor added.
