Penza, 22 September 2016. PenzaNews. A resident of Akhuny village Irina Chernyshova, a single mother raising a 4-year-old daughter and a 17-year-old disabled son, turned to the head of the Federal Service for State Registration, Cadastre and Cartography (Rosreestr) in the Penza region Igor Kudinov and the prosecutor of the region Natalia Kantserova with the request to conduct checks on the fact of unauthorized seizure of land on Spartakovskaya Street.

“I ask you to carry out checks on the unauthorized seizure of land plot with cadastral number 58: 59: 2005010: 17, located in Penza, Spartakovskaya Street, 9B, as the owner of house installed a fence blocking the pedestrian public road. Also the unauthorized plot of land contains a garage and a part of the house,” Irina Chernyshova’s letter states, a copy of which is available to PenzaNews.

It also notes that the use of the site without legal documents is a violation of the land legislation.

In this regard, Irina Chernyshova asks to bring the offender to justice, impose a fine and release illegally occupied land.

For the first time this illegal land seizure issue was touched upon six months ago, when civic activist Victor Khomets addressed the Penza authorities appealing through the media.

The documents that the journalists received then testified that the area enclosed by a fence with a two-storey brick apartment building, is much larger than indicated in the plan.

According to lawyers, who studied those materials, the owner of the site actually appropriated part of municipal land, which is expensive in that part of the city: the cost of 1 sq. meter is no less than 100 thousand rubles.

Later formal verification conducted by qualified inventory specialists confirmed the seizure of land. In particular, it was found that the portion of Spartakovskaya Street, 9B is considered an area of 433 sq. meters in the state cadastre of real estate. Permitted use - individual residential development.

As a result of topographical measurements, it was found that this plot is used in larger area boundaries. It is surrounded by a single wall, and includes a portion which is in the conduct of local government.

A person, who committed an administrative offense, was issued an order to eliminate the revealed violations of the land legislation in the period before September 15, but so far the high stone fence is still in the same place. In April the regional prosecutor's office came to the defense of the land owner, who did not use it in business purposes.

Residents of Akhuny, concerned about unauthorized land occupation, which had long been documented, but is still unpunished, intend to appeal to the mayor of Penza Victor Kuvaytsev, Governor Ivan Belozertsev, as well as the administration of the Russian president to, in their words, “return the site owner in Russia's legal personality,” because the law should treat everyone evenly.
