Penza, 30 September 2016. PenzaNews. The Penza regional court upheld the decision of the Gorodishche area court where two teachers were refused in reinstatement.

“One teacher used to work at Srednyaya Elyuzan village school No. 1 since 1993, and in 2011 was transferred to the position of teacher-psychologist. The second teacher had worked since 2003 at the school of Chaadaevka village, and in 2005 was transferred to the position of chemistry teacher. As of July 11, 2016, both teachers were dismissed by the school directors,” the press secretary of the Penza regional court Natalia Bychenkova told PenzaNews.

She said that the reason was the violation during the unified state exam.

“In spite of the prohibition to assist participants on the day of the exams, teachers gave students the opportunity to take advantage of two cell phones. Thus, they deliberately violated the law on the procedure of the state final examination. According to the revealed facts, the examination committee of the Ministry of Education of the Penza region had to void Russian language exam results of two students,” the agency interlocutor explained.

According to her, the teacher found the dismissal illegal.

“With reference to the court, the plaintiffs stated that the employer violated the order of dismissal, the order of the disciplinary action does not contain evidence of the event of a disciplinary offense and facts referring the offence to immoral and incompatible with the continuation of work. The representatives of the educational establishments explained that the decision to dismiss the teachers was made upon watching the video of examination,” Natalia Bychenkova added.

She pointed out that the court considered the dismissal of teachers lawful, since according to the instructions familiar to the teachers, they were forbidden to assist students on the day of the exam.

“The teacher should remind the participants on video surveillance and the ban on any communication devices, computing appliances, photographic, audio, video equipment, reference materials, and other means of storing and transmitting information. In case of existence of the listed items, the exam participant is removed from the exam room, and the corresponding report is compiled,” the press secretary of the regional court concluded.
