Penza, 15 December 2016. PenzaNews. The court obliged the Penza administration to register the pedestrian bridge that connects Vyazemskogo and Leonova streets and goes over the railroad as ownerless.

As it was reported by the press secretary of the Penza regional court Natalia Bychenkova, the claim was brought by the transport prosecutor in the interests of indefinite range of people.

“The pedestrian bridge is located over the railroad at the 708 km of the railway ‘Station Penza 1 – Station Arbekovo’. The commission examination established that the bridge is in critical condition. At the moment of the examination – on July 13, 2016, the painting of the pedestrian crossing and the concrete covering were 100% worn. The condition of the steps and the railing is also unsatisfactory, the lighting is absent. The span fence along the whole length of the pedestrian bridge is covered with corrosion, the concrete floor is breaking down, which may lead to the fall of the construction to the railway,” the interlocutor explained.

She added that because of that, the residents have to cross the railroad across the railway risking their lives.

“The bridge construction is not registered in the lists of federal, regional and municipal property. Other people’s property right to the object is not registered. And the bridge was never owned by LLC ‘RZD’,” the press secretary of the regional court noted.

Natalia Bychenkova explained that the Penza mayor’s office is the only body that has the right to submit an application to register the property as ownerless.

“Having studied the case materials, the court obliged the Penza administration to turn to the body that carries out state registration of real estate property right with the written request to register the pedestrian bridge as ownerless. The sentence came into effect,” the interlocutor summed up.
