Prosecutor's office twice denies results of inspection that involves Tuzov

Penza, 27 July 2017. PenzaNews. The prosecutor's office of the Pervomaisky area of Penza two times during a month denied results of a pre-investigation check under the Art. 128.1 of the Criminal Code of the Russian Federation "Libel" that involves Alexander Tuzov, ex-officer of the Federal Security Service, member of the public council under the regional department of the Ministry of Internal Affairs of Russia, editor-in-chief of an Internet medium.

The check on the men's application on conscious spread of false information in the mass media that tarnished his honour and dignity as well as damaged his reputation was conducted from the end of March to June 11 when the district police officer of department No. 4 of the MIA in Penza Rustam Ryakhmyatullin passed a judgment to refuse opening a criminal case.
At the same time, according to information available to PenzaNews, the document stated that Alexander Tusov refused giving any explanation in person but provided a worker of the police with some clarification by phone.
The document has no information regarding the way the district police officer Rustam Ryakhmyatullin established the identity of the man whose information formed the basis of the decree to deny a criminal case.
On July 13, in the exercise of supervisory powers the regional prosecutor's office denied the accepted document and sent it back to police department No. 4 of the MIA in Penza for additional investigation.
Five days later, on July 18, another district police officer – Oleg Lekarev – passed the second judgment to deny opening a criminal case under the Art. 128.1 of the Criminal Code of the Russian Federation "Libel" indicating the reason "absence of the event of a crime".
However, the prosecutor's office of the Pervomaisky area did not agree with the decision again and on July 24 cancelled the document prepared by the police due to its illegitimacy and lack of justification.
Currently, the materials were again sent to police department No. 4 of the MIA of Russia in Penza for additional investigation. It still remains unknown what department police officer studies the case – the same or another one.
Commenting on the situation, a source in the law enforcement authorities told PenzaNews on condition of anonymity that the department as a whole and the general Yuri Ruzlyaev in particular "find the pre-investigation check disadvantageous and unpleasant" because it involves the member of the public council under the regional department of the Ministry of Internal Affairs of Russia Alexander Tuzov, that is why all efforts will be put to finish the investigation as soon as possible.
"Until the moment when the information became known to the mass media it was better not to pay attention to the problem and to take as much time as possible. The investigation was conducted since spring but no one talked about it publicly. At present, the situation changed drastically. Ruzlyaev receives questions openly and sooner or later he will have to react to them somehow. Since it damages the image, I think, there will be attempts to level the situation hastily. However, the simplest solution is Alexander Tuzov's exclusion from the public council under the regional department of the Ministry of Internal Affairs. As the saying goes – no man is no problem," the interlocutor explained.
