Penza, 28 October 2017. PenzaNews. The Nikolsk area court of the Penza region denied recovery of a credit debt from a woman in favour of the state corporation Deposit Insurance Agency because the signature in the credit contract was put by another person.

"Deposit Insurance Agency filed a lawsuit against a woman to recover credit contract arrears amounting to over 4 million roubles. The plaintiff stated that by the decision of the arbitration court of the Samara region as of February 18, 2015, the LLC Commercial Bank 'Volga Credit' was declared bankrupt and a 1-year bankruptcy proceeding started against it. The State Corporation was chosen a managing company," an official representative of the Nikolsk area court told PenzaNews.

He explained that the bank issued the defendant a loan equalling 15,000 roubles by transferring the money on her account.

"The obligation to repay the credit in full was not fulfilled within a prescribed period," the interlocutor specified.

According to him, the woman objected to the claim on the grounds that she had not concluded the credit contract and the signature on the document was not hers.

"At a woman's request a handwriting examination was assigned, which proved that the signature on the credit contract was put by another person," the court representative explained.

He noted that the expert's opinion had not been refuted.

"The expert's findings confirmed that the credit contract had not been signed by the woman, which invalidates the loan," the interlocutor summed up.

Other circumstances are not clarified.
