Penza, 28 March 2018. PenzaNews. A Penza resident achieved compensation for moral damages through court after receiving burns in a cedar barrel in the SPA Milena.

"As it was established, the plaintiff was presented with a certificate for visiting the SPA Milena of LLC Spa-wellness on her birthday. She registered for the procedure called "Cedar barrel" in advance and arrived at the salon at an appointed time on June 17, 2017. A worker let her in a cedar barrel and left unattended," senior assistant of the regional prosecutor for media relations Svetlana Artamonova told PenzaNews.

She added that during the procedure the temperature in the barrel started to increase and the switch of the steam generator began to click.

"The client felt unwell but failed to get out of the barrel without assistance and lost consciousness. Having come to consciousness the plaintiff understood that workers of the salon were trying to take her out of the barrel. Her skin on her shins, left foot and right thigh was bright red. Her parents picked her up from the salon. On the same day she was taken to hospital by ambulance, where she remained for 21 days, and then underwent out-patient treatment," the interlocutor explained.

Svetlana Artamonova specified that when conducting forensic examination experts established burns to the shins, right thigh and left foot on a total area of 2% with the formation of nine scars.

"Subsequently she turned to the SPA with a claim for damage recovery but received no response," the senior assistant of the regional prosecutor noted.

She reported that the Pervomaisky district court of Penza partially satisfied woman's requirements and recovered a compensation for moral damages in the amount of 150,000 roubles, the cost of the certificate – 2,000 roubles, the cost of treatment in a proved amount – about 21,000 and lost earnings – about 26,000 roubles.

"In addition the court exacted a fine in the amount of 99,400 roubles from the defendant in behalf of the plaintiff and the public organization for consumer protection, which represented the woman before the court," Svetlana Artamonova added.

She noted that the defendant appealed the decision of the court of the first instance but the regional court left it unchanged.
