Penza “Avtolotsman” sues for nearly 1 billion rubles after agreements break-off

Penza, 15 October 2015. PenzaNews. Eduard Artemyev of “Avtolotsman” has addressed the Penza region Arbitration Court with a case against “General Motors SNG” and “General Motors Daewoo Auto and Technology SNG” with intent to get back 936,382,546 rubles of damages.

According to legal background, the litigants unilaterally broke off the agreements with “Avtolotsman” on sales and dealership services – the agreement with “General Motors SNG” No. RU0104-1, dated 23 October 2006; and the agreement with “General Motors Daewoo Auto and Technology SNG” No. RUD104-DAT-1, dated 23 October 2006.
It follows to claim that “Avtolotsman” suffered damages as a result as current legislation demands the organization to continue providing guarantee services to buyers as per the aforementioned agreements.
According to complainant, the expenses “Avtolotsman” suffers due to obligation to provide guarantee service includes guarantee repairs and a number of car recalls.
The information acquired by PenzaNews agency says that a representative of “General Motos SNG” filed a request to transfer the case to the Moscow Arbitration Court on the grounds that the case constitutes a tort that must be reviewed at the place of location of the respondent, and a representative of “General Motors Daewoo Auto and Technology SNG” supported the request.
The case has been set for trial.
The session is scheduled to take place on November 18 in the Penza region Arbitration Court.
